In other news, the Yanks are trying to take the mileston bonuses out of ARod's contract. I can't believe they haven't done that already. We'll see what happens there. I'm still not 100% sure he ever plays for the Yankees again.
Still waiting on Moncada.

I don't think they have a strong case. Either they try to void the terms of the whole contract, or pay the terms of the contract.
My guess, however, is that guys like Levine, and maybe Cashman, don't want to be deposed.
Some one on another blog stated it may be a separate contract if that has any say in the matter based on promotions??

I liked that line from the article only because it was in reference to my alma mater. In reality, though, it's not unheard of for true freshmen to see significant playing time at Alabama if they separate themselves. I imagine the same bodes true for any Yankee that is worthy of moving fast through the system.
We'll see if the Yanks start being more aggressive with promotions -- outside the machinations of the trade deadline.
If the Yankees are that desperate about $6 or $12 million (I really doubt he catches Bonds and Aaron and don't think the Babe is a cinch either), can't they just glue him to the bench like a Rule 5 draftee and play with 24 men? I can't see any arbitrator telling Girardi whom to play or when to play them. Am I right that if they DFA him and outright him to Scranton and he elects free agency they still are on the hook for his salary?

Yup, it's MLB. The new Commish; however is the one the Yanks wanted so -- maybe not much longer.
The Commish would consider banning shifts? What?
I work as a financial consultant for a Law Firm that is on retainer with MLB. While I never met any MLB "bigwigs" in the MLB offices, I did meet some "higher-ups' in the Law firm's office from time-to-time. Once, at a conference, one of the Managing partners made a comment that the MLB standard contract is one of the most difficult to break, with the rules in place based on the Basic Agreement with the Players Union. Another lawyer for MLB was in the room, and was "vigorously" nodding his head in agreement.
Just saying. I seriously doubt the Yankees have any case, unless there is some specific language in that contract.
